In the following, we, Siegbert Spohr GmbH, provide information regarding the processing of personal data in connection with business relationships and contracts concluded by Siegbert Spohr GmbH and their fulfillment.

 

§1 - Definitions

  1. Personal data refers to all data that can be personally attributed to you, such as your name, address, email addresses, payment information, and ordered goods.

§4 - Purposes, Scope, and Legal Basis of Processing

  1. We process, and in particular collect and store, your data to the extent necessary to provide the services contractually agreed upon with you and to fulfill the purchase agreement concluded with you. This applies in particular to your address and payment information, as well as the details of your order.
  2. If we ship goods to you at your request, we will disclose your data to the contracted shipping company to the extent necessary for shipment.
  3. If the goods you ordered are shipped directly to you from the warehouse of our agent, we will disclose your data to the respective agent to the extent necessary for delivery.
  4. Any further use of your data will only occur if you have given your consent to such use.
  5. The legal basis for processing is currently Section 28(1), Sentence 1, No. 1 of the German Federal Data Protection Act (BDSG). As of May 25, 2018, the legal basis for processing will be Article 6(1)(b) of the General Data Protection Regulation (GDPR).

 

§5 - Recipients / Categories of Recipients of Your Data

In some cases, we use external service providers based in the European Union to process your data. We have carefully selected these service providers, commissioned them in writing, and bound them to our instructions. We monitor them regularly. The service providers will not disclose your data to third parties but will delete it after the contract has been fulfilled and the statutory retention periods have expired, unless you have consented to further storage.

 

§6 - Retention Period for Your Data

Your data will be retained for the duration of the business relationship, but no longer than 6 months after the business relationship ends.

 

§7 - Your Rights

  1. You have the right to receive comprehensive information at any time regarding your personal data stored by us.
  2. If the data we have stored about you is inaccurate, you may request that it be corrected or supplemented at any time.
  3. Provided the conditions set forth in Article 17 or Article 18 of the GDPR are met, you have the right to request the erasure or restriction of the processing of your personal data stored by us.
  4. You have the right to object to the processing of your personal data at any time under the conditions set forth in Article 21 of the GDPR.
  5. Under the conditions set forth in Article 20 of the GDPR, you also have the right to data portability.
  6. Finally, you have the right to lodge a complaint with the competent supervisory authority, if necessary.
  7. Any such requests should be directed to the data protection officer named in Section 3.

 

§8 - Technical and Organizational Measures to Protect Your Data

  1. We maintain up-to-date technical measures to ensure data security, in particular to protect your personal data from risks associated with data transmission and from unauthorized access by third parties. These currently include hardware and software firewalls and are regularly updated to reflect the latest state of the art.
  2. Your data is always transmitted in encrypted form.

Our website contains links to third-party websites or those of affiliated companies. When you click on these links, you leave our website and, consequently, the scope of this Privacy Policy. Siegbert Spohr GmbH is not responsible for these other operators’ compliance with legal requirements. Responsibility lies solely with the respective website operator.

To do this, reCAPTCHA analyzes the website visitor’s behavior based on various characteristics. For the analysis, reCAPTCHA evaluates various pieces of information (e.g., IP address, the length of time the website visitor spends on the website, or mouse movements made by the user).
  2. The data collected during the analysis is forwarded to Google. Data processing is based on Article 6(1)(f) of the GDPR. The website operator has a legitimate interest in protecting its web offerings from abusive automated surveillance and from spam.

  1. If you would like to subscribe to the newsletter offered on this website, we need your email address as well as information that allows us to verify that you are the owner of the provided email address and that you consent to receiving the newsletter. We use this data exclusively to send you the requested information and do not share it with third parties.
  2. This website uses Brevo (formerly Sendinblue) to send newsletters. The provider is Sendinblue GmbH, Köpenicker Straße 126, 10179 Berlin, Germany. Brevo (formerly Sendinblue) is a service that can be used, among other things, to organize and analyze the distribution of newsletters. The data you provide to subscribe to the newsletter is stored on Brevo’s (formerly Sendinblue) servers in Germany. If you do not want your data analyzed by Brevo (formerly Sendinblue), you must unsubscribe from the newsletter. We provide a link for this purpose in every newsletter message.
  3. Data analysis by Brevo (formerly Sendinblue): With the help of Brevo (formerly Sendinblue), we are able to analyze our newsletter campaigns. This allows us, for example, to see whether a newsletter message was opened and which links, if any, were clicked.   1. Our website uses plugins from the Google-operated site “YouTube.” The site is operated by YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages that includes a YouTube plugin, a connection is established with YouTube’s servers. In the process, the YouTube server is informed which of our pages you have visited.
  2. If you are logged into your YouTube account, you allow YouTube to associate your browsing activity directly with your personal profile. You can prevent this by logging out of your YouTube account.

§15 – Instagram

  1. We use components of the Instagram service. Instagram is a service that qualifies as an audiovisual platform and enables users to share photos and videos, as well as to repost such content on other social networks. Instagram is operated by Instagram LLC, 1 Hacker Way, Building 14, First Floor, Menlo Park, CA, USA. Each time a user visits a page on this website that includes an Instagram component (Instagram button), Instagram is notified of which specific subpage of our website the user is visiting.
  2. If you are logged into Instagram at the same time, Instagram will recognize which specific subpage you have visited each time you visit our website and throughout the duration of your visit to our website. This information is collected by the Instagram component and associated with your Instagram account by Instagram. If you click one of the Instagram buttons integrated into our website, the data and information transmitted through it are associated with your personal Instagram user account and are stored and processed by Instagram.
  3. Instagram receives a notification via the Instagram component that you have visited our website whenever you are logged into Instagram at the same time you access our website; this occurs regardless of whether you click on the Instagram component or not. §16 – LinkedIn

  1. We use LinkedIn, a service provided by LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. Please note that you use this LinkedIn page and its features at your own risk. This applies in particular to the use of interactive features (e.g., commenting, sharing, rating).
  2. When you visit our LinkedIn page, LinkedIn collects, among other things, your IP address and other information stored on your computer in the form of cookies. This information is used to provide us, as the operator of the LinkedIn pages, with statistical information about the use of the LinkedIn page.   3. The data collected about you in this context is processed by LinkedIn Inc. and may be transferred to countries outside the European Union. LinkedIn does not clearly and definitively specify how it uses data from visits to LinkedIn pages for its own purposes, to what extent activities on the LinkedIn page are attributed to individual users, how long LinkedIn stores this data, or whether data from a visit to the LinkedIn page is shared with third parties; we are not aware of this information.
  5. When you access a LinkedIn page, the IP address assigned to your device is transmitted to LinkedIn. According to LinkedIn, this IP address is anonymized (for “German” IP addresses) and deleted after 90 days. LinkedIn also stores information about its users’ devices (e.g., as part of the “login notification” feature); which may allow LinkedIn to associate IP addresses with individual users.
  6. If you are currently logged into LinkedIn, a cookie containing your Facebook ID is stored on your device. This enables LinkedIn to track that you have visited this page and how you used it. This also applies to all other LinkedIn pages. Through LinkedIn buttons embedded in websites, LinkedIn can track your visits to these websites and associate them with your LinkedIn profile. Based on this data, content or advertising can be tailored to you.
  7. If you wish to avoid this, you should log out of LinkedIn or disable the “Stay logged in” feature, delete the cookies stored on your device, and close and restart your browser. This will delete any LinkedIn information that could be used to directly identify you. This allows you to use our LinkedIn page without revealing your LinkedIn ID. When you access interactive features on the page (Like, Comment, Share, Messages, etc.), a LinkedIn login screen will appear.
